How is detailed child support calculated?
Detailed child support calculation is based on the Israeli Supreme Court ruling in HCJ 919/15. This landmark decision established that both parents share the obligation to support their children based on their financial capacity.
The first step calculates each parent's effective income by summing all income sources: salary, business income, investments, rental income, and benefits. If the court attributes earning capacity, the imputed income replaces actual income.
Base needs per child are set by age: ₪1,500 for ages 0-5, ₪1,750 for ages 6-11, ₪2,100 for ages 12-17. Additional expenses like private education, healthcare, childcare, and extracurricular activities are also factored in.
For children ages 0-5, the obligation is absolute — the paying parent bears all base needs without custody offset. From age 6+, the obligation is proportional — based on income ratio minus custody ratio.
Housing costs are calculated using fixed percentages (33% for 1 child, 40% for 2, 55% for 3+) and split by income ratio. Transportation costs are split similarly.
The family's standard of living acts as a multiplier — from low (×0.85) to high (×1.30). The self-support mechanism ensures the paying parent retains at least ₪5,500 per month.
Additional factors the court considers
Beyond the base formula, the court considers these additional factors:
- Earning capacity — potential income when a parent is underemployed or not working
- Children from prior relationships — 10% reduction per child (up to 40%) from effective income
- Special needs — 25% supplement to base needs for children with disabilities or special requirements
- Existing support obligations — amounts ordered for other children are deducted from income
- Family standard of living — multiplier reflecting the lifestyle children are accustomed to
- Court discretion — the court may deviate up to ±15% from the formula in special circumstances
Calculation Examples
Here are some sample scenarios:
1Couple with one child, equal custody
Parent A earns ₪15,000 (salary), Parent B earns ₪10,000. Child age 8, custody 7/7. Housing: ₪4,000 and ₪3,000. Average standard of living.
Estimate: ~₪241/month (Parent A to Parent B). Range: ₪205–₪277.
2Two children, mixed ages
Parent A earns ₪20,000, Parent B earns ₪12,000. Daughter age 3 and son age 10. Custody 7/7. No additional expenses.
Estimate: ~₪1,775/month. Daughter (0-5) has absolute obligation, son (6+) has proportional obligation.
3Earning capacity and prior children
Parent A earns ₪8,000 but earning capacity is ₪15,000, with 2 children from prior relationship. Parent B earns ₪18,000. Child age 12.
Parent A's effective income: ₪15,000 × 0.8 = ₪12,000 (20% discount). Calculation based on ₪12,000 vs ₪18,000.
